Case involving Colorado City man sent back to grand jury
 
 
KINGMAN ­ The cases for three Colorado City defendants moved forward Monday, while another was sent back to the grand jury. All the defendants face charges related to sexual conduct with a minor.

The prosecution suffered a setback in the David Bateman case when Superior Court Judge James Chavez granted defense's motion to remand the case to the grand jury for a new determination of probable cause.

Chavez denied, however, the defense's motion to dismiss the case altogether. He also ordered that if the grand jury makes a new finding of probable cause, the bond previously made by the defendant will remain in effect.

Bateman is charged with sexual conduct with minors and conspiracy to commit sexual conduct with minors.

Rodney H. Holm came before Superior Court Judge Steven F. Conn Monday for a case management hearing. Both Holm and his attorney, Bruce Griffin from Flagstaff, participated by telephone. Holm is charged with three counts of sexual conduct with a minor.

According to Griffin, he does plan to file motions in this case, the one of note being a motion to remand the case to the grand jury for a new indictment.

Conn set an omnibus hearing for 1:30 p.m. Oct. 3 pending the motion actually being filed, at which point he said they could reschedule to include oral arguments about the motion.

Likewise, in the case of Terry D. Barlow, both the defendant and Griffin participated via telephone. Griffin stated that he plans to challenge the grand jury indictment in this case as well. An omnibus hearing was set for 1:30 p.m. Oct. 3. Barlow is charged with sexual conduct with a minor and one count of conspiracy to commit sexual conduct with a minor.

Dale Evans Barlow participated via phone before Superior Court Judge Richard Weiss. Griffin stated that he had already filed a motion to challenge the grand jury indictment. Weiss ordered transfer of the case to a different court due to a conflict he has with a juvenile case. All future hearings are pending.
